OVERVIEW
This website is operated by Smukke House Inc. Throughout the Site, the terms “we,” “us” and “our” refer to Smukke House Inc.
Smukke House offers this website, including all information, tools, products and services available through smukkehouse.ca (the “Site”), subject to these Terms of Service (“Terms”).
By visiting our Site, using our Services or purchasing from us, you agree to be bound by these Terms and by the policies referenced herein, including our Refund & Return Policy, Shipping Policy and Privacy Policy.
Please read these Terms carefully before accessing or using the Site.
Nothing in these Terms limits any rights or remedies available to you that cannot legally be excluded under applicable consumer protection law.
1. ONLINE STORE TERMS
You may not use the Site, our products or our Services for any illegal or unauthorized purpose or in violation of any applicable law.
You must not transmit viruses, malicious code or other material that could interfere with the operation or security of the Site.
We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, pricing or inventory errors, unauthorized resale activity or violation of these Terms.
2. AGE-RESTRICTED & INTIMATE WELLNESS PRODUCTS
Certain products available through The Sacred Room are intended for adults and may be subject to age restrictions.
By purchasing an age-restricted or intimate wellness product, you represent that you have reached the age of majority in your province or territory of residence and are legally permitted to purchase and use the product.
You are responsible for ensuring that your purchase, possession and use of any product complies with the laws applicable to you.
Smukke House reserves the right to refuse or cancel an order for an age-restricted product where we reasonably believe the purchaser does not satisfy applicable age requirements.
3. PRODUCTS & AVAILABILITY
Certain products may be available exclusively online and may be available only in limited quantities.
Products are subject to availability. We may discontinue products, change our assortment or limit quantities at any time.
We make reasonable efforts to display product descriptions, specifications, dimensions, colours and images accurately. However, colours may appear differently depending on your screen or device, and manufacturer packaging, branding or product presentation may change from time to time.
Where product information, specifications, ingredients or usage instructions are supplied by a manufacturer or authorized distributor, we rely on that information in presenting products on the Site.
If there is a material error in a product description, price or availability, we may correct the error and, where appropriate, contact you regarding an affected order.
4. PRICES & PAYMENT
Unless otherwise stated, prices displayed on the Site are in Canadian dollars (CAD).
Applicable taxes and shipping charges, where applicable, are calculated or disclosed during checkout.
Prices and promotions may change from time to time.
We reserve the right to correct pricing errors. If a material pricing error affects an order already submitted, we may contact you before fulfilment to provide the available options, subject to applicable law.
Any conditions or limitations associated with a promotion, discount or offer will be disclosed with the applicable offer.
5. ORDERS
Submitting an order does not necessarily mean that the order has been accepted or can be fulfilled.
We reserve the right to decline or cancel an order for legitimate reasons, including suspected fraud, payment authorization issues, inventory errors, pricing errors, product restrictions or circumstances affecting our ability to fulfil the order.
If we cancel an order after payment has been processed, the applicable amount will be refunded.
You agree to provide current, complete and accurate billing, shipping and contact information when placing an order.
You are responsible for reviewing your order and delivery information before submitting your purchase.
6. SUPPLIER-DIRECT & SPECIALTY PRODUCTS
Certain products, including some beauty technology, intimate wellness products, furniture and oversized items, may be fulfilled and shipped directly by an authorized Canadian distributor or other fulfilment partner.
By placing an order for such a product, you authorize Smukke House to provide the fulfilment partner with the information reasonably necessary to process and deliver your order.
Supplier-direct products may have different processing, delivery, cancellation and shipping requirements.
Orders containing products fulfilled from multiple locations may arrive in separate shipments.
Certain supplier-direct, furniture, oversized or special-order products may not be cancelled once processing has begun.

7. INTIMACY FURNITURE & OVERSIZED PRODUCTS
Customers are responsible for reviewing product dimensions, specifications, colour and intended use before purchasing furniture, positioning products or other oversized items.
You are also responsible for ensuring that the product is suitable for your intended location and can be accommodated through applicable entrances, hallways, stairways and other access points.
Furniture, oversized products and certain specialty products are final sale except as otherwise stated in our Refund & Return Policy or required by applicable law.
8. RETURNS, REFUNDS & FINAL-SALE PRODUCTS
Returns, refunds and exchanges are governed by our Refund & Return Policy.
Certain categories, including intimate wellness products and specialty furniture, may be final sale for hygiene, safety or product-specific reasons as described in that policy.
Nothing in our Refund & Return Policy or these Terms limits any rights or remedies that cannot legally be excluded under applicable consumer protection law.
9. SHIPPING & DELIVERY
Shipping, delivery, signature requirements, supplier-direct fulfilment, missing parcels and damaged shipments are governed by our Shipping Policy.
Delivery dates and transit times are estimates unless expressly stated otherwise.
Carrier delays, weather, labour disruptions and other circumstances outside our reasonable control may affect delivery.
10. PRODUCT USE & SAFETY
Products purchased from Smukke House should be used only for their intended purpose and in accordance with manufacturer instructions, warnings and safety information.
You are responsible for reading and following instructions supplied with a product before use.
Do not use a product if you have reason to believe that doing so may be unsafe for you. If you have a medical condition, are pregnant, use an implanted or electronic medical device, take medication or have another health concern that may affect whether a particular skincare product, beauty device or wellness product is appropriate for you, consult an appropriate healthcare professional before use.
11. SKINCARE, BEAUTY & WELLNESS INFORMATION
Information provided on the Site, including product descriptions, articles, guides, consultations and educational content, is provided for general informational and product-selection purposes.
It is not medical advice and is not intended to diagnose, treat, cure or prevent any medical condition or replace advice from a qualified healthcare professional.
Smukke House online skincare consultations are intended to assist with product selection and skincare routines. They do not constitute medical diagnosis or treatment.
Individual results from skincare, beauty technology and wellness products vary.
If you experience an adverse reaction or have a medical concern, discontinue use where appropriate and consult a qualified healthcare professional.
12. INTIMATE WELLNESS INFORMATION

Intimate wellness products should be used according to manufacturer instructions and for their intended purpose.

13. BEAUTY TECHNOLOGY & DEVICES
Beauty devices and technology should be used in accordance with manufacturer instructions, contraindications and safety information.
Certain devices may not be appropriate for everyone.
Customers are responsible for reviewing applicable contraindications before use and obtaining professional medical advice where appropriate.
Manufacturer warranties may apply to certain devices and are subject to the applicable manufacturer's or distributor's warranty terms.
14. INTELLECTUAL PROPERTY
Unless otherwise indicated, the Site and its original content, including text, graphics, editorial content, design elements, photographs, logos and other materials created or owned by Smukke House, are owned by or licensed to Smukke House and are protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, publish, sell or commercially exploit Smukke House content without prior written permission.
Third-party brand names, trademarks, product images and other intellectual property appearing on the Site remain the property of their respective owners and are used under authorization, licence or other lawful basis where applicable.
15. THIRD-PARTY TOOLS & LINKS
The Site may contain links to third-party websites or provide access to tools or services operated by third parties.
Smukke House does not control third-party websites and is not responsible for their content, availability, privacy practices or terms.
Your use of third-party websites, services or tools is subject to the applicable third party's terms and policies.
16. REVIEWS, COMMENTS & SUBMISSIONS
If you submit a product review, comment, suggestion, photograph or other content to Smukke House, you represent that you have the right to provide that content and that it does not violate the rights of another person or applicable law.
You grant Smukke House a non-exclusive, royalty-free licence to use, reproduce and display content you voluntarily submit for publication, marketing or promotional purposes, subject to applicable privacy law and any permissions or restrictions communicated at the time of submission.
We may remove content that we reasonably consider unlawful, abusive, misleading, infringing, obscene or otherwise inappropriate.
17. PROHIBITED USES
You may not use the Site or its content:
- For an unlawful or fraudulent purpose.
- To violate applicable laws or regulations.

We do not guarantee that access to the Site will always be uninterrupted, secure or error-free.

To the maximum extent permitted by applicable law, Smukke House Inc. and its directors, officers, employees, agents and service providers will not be liable for indirect, incidental, special or consequential losses arising from the use of the Site or Services where such liability may lawfully be excluded.
Nothing in these Terms excludes or limits liability where doing so is prohibited by applicable law.
Nothing in these Terms limits any rights or remedies available to consumers under applicable consumer protection legislation.
21. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Smukke House Inc. and its directors, officers, employees and agents from claims, losses or reasonable costs arising directly from your unlawful use of the Site, your material breach of these Terms or your infringement of the rights of another person.
22. PRIVACY
Our collection, use and disclosure of personal information is governed by our Privacy Policy.
Where an order is fulfilled by a distribution, shipping or other service partner, personal information may be disclosed as reasonably necessary to process and deliver the order, as described in our Privacy Policy.
23. SEVERABILITY
If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
24. WAIVER
Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.
25. ENTIRE AGREEMENT
These Terms, together with the policies and other terms expressly incorporated by reference, constitute the agreement between you and Smukke House concerning your use of the Site and Services.

These Terms and your use of the Services are governed by the applicable laws of Ontario and the federal laws of Canada applicable therein, without limiting any mandatory consumer protection rights that apply to you under the laws of your province or territory of residence.

We may update these Terms from time to time to reflect changes to our Services, business practices or legal and regulatory requirements.
The current version will be posted on the Site with an updated revision date.
Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
